TERMS OF SERVICE

1. Acceptance of Terms
By accessing or using InspectorHub (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. These terms apply to the hosted InspectorHub cloud platform. The self-hosted open-source OpenInspection software is governed by the GNU Affero General Public License v3 (AGPL v3).
2. Account Registration
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
3. Acceptable Use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You shall not: (a) use the Service to violate any applicable law or regulation; (b) attempt to gain unauthorized access to any part of the Service; (c) interfere with or disrupt the integrity or performance of the Service; (d) upload or transmit viruses, malware, or other malicious code; (e) use the Service to store or transmit infringing, libelous, or otherwise unlawful material.
4. Your Data
You retain all rights to the data you submit to the Service ("Your Data"). By using the Service, you grant us a limited license to store, process, and display Your Data solely for the purpose of providing the Service to you. We will not access, use, or share Your Data except as necessary to provide the Service, comply with the law, or enforce these Terms. You may export or delete Your Data at any time.
5. Data Roles & Responsibilities
Your workspace stores personal data about your own clients — for example homebuyers, agents, and the people named in your inspections. With respect to that end-client data, you are the data controller: you decide why and how it is processed, you are responsible for having a lawful basis to collect and use it, and you are responsible for providing your own privacy notice to your clients. We act only as your processor: we process end-client data on your documented instructions and in accordance with our Privacy Policy, and we do not use it for our own purposes. This division of roles does not apply to your own account and billing information, for which we are the controller.
6. Workspace & Team Management
Each workspace on InspectorHub is a separate, isolated tenant. As a workspace owner, you are responsible for managing team members, permissions, and data within your workspace. You may invite team members who will be bound by these Terms. Removing a team member revokes their access to the workspace but does not delete their InspectorHub identity.
7. Security Features
We provide security features to help you protect your workspace, including two-factor authentication (2FA) and role-based access control. Whether to enable and enforce these features within your workspace is the account owner's decision. Choosing to turn them on, and configuring member roles appropriately, is part of the account-safeguarding responsibility described in Section 2. We are not responsible for unauthorized access that results from your decision not to enable an available protection.
8. Billing & Payments
Certain features of the Service require a paid subscription. Prices are listed on our pricing page and may change with 30 days' notice. Subscription payments to InspectorHub are processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. Separately, you may connect your own Stripe account to collect payments from your clients. Any payment your client makes through your connected Stripe account is a transaction between you, your client, and Stripe — InspectorHub is not a party to it, does not receive those funds, and is not responsible for those payments, refunds, or disputes.
9. Service Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance with advance notice. We are not liable for any downtime, data loss, or damages resulting from service interruptions beyond our reasonable control.
10. Indemnification
You agree to hold harmless and indemnify InspectorHub and its affiliates against any third-party claim, demand, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or any fault on your side. This includes claims brought by your own clients, and claims arising from unauthorized access caused by your negligence — for example, credentials that were compromised because they were not kept secure or because an available security feature was not enabled.
11. Security Incident Notification
If we confirm a personal-data breach affecting our platform systems, we will notify affected workspaces without undue delay and share the information reasonably available to us. Because you are the controller of your end-client data, any onward notification to your own clients, or to a regulator or supervisory authority, is your responsibility. We will assist you with information you reasonably need to meet those obligations.
12. Limitation of Liability
To the maximum extent permitted by law, InspectorHub and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your use of the Service.
13. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. You may request an export of Your Data within 30 days of termination. After 30 days, we may delete Your Data in accordance with our data retention policy.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated terms and updating the effective date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
